Terms of Service

1. Agreement to Terms

By accessing or using the CONSETO platform, website (www.conseto.io), and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you ("you" or "Customer") and DIGITAL SPECIALISTS s.r.o. ("CONSETO," "we," "us," or "our"), a company registered in Slovakia.

2. Description of Services

CONSETO provides a web analytics and GDPR compliance platform that includes:

Website analytics and event tracking
Cookie consent management and banner tools
GDPR audit and compliance tools
E-commerce tracking and conversion analytics
API access and integrations

3. Account Registration

To use certain features of the Services, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Promptly update any information that changes
Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Services to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Services
Collect data without proper legal basis or consent
Track individuals without appropriate disclosures

5. Subscription Plans and Payment

5.1 Plans

We offer various subscription plans with different features and limits. Plan details, including pricing, are available on our pricing page. We reserve the right to modify plans and pricing with 30 days' notice.

5.2 Payment

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms. We use third-party payment processors and do not store your payment card details.

5.3 Free Trial

We may offer free trials of paid features. At the end of the trial, you will be charged unless you cancel before the trial ends.

6. Intellectual Property

The Services, including all content, features, and functionality, are owned by CONSETO and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain all rights to your data. By using the Services, you grant us a limited license to process your data solely to provide the Services.

7. Data Processing

When you use our Services to collect data from your website visitors, we act as a data processor on your behalf. You remain the data controller and are responsible for complying with applicable data protection laws, including obtaining necessary consents. Our Data Processing Agreement governs this relationship.

8. Service Availability

We strive to maintain reasonable uptime but do not guarantee uninterrupted access. We may temporarily suspend Services for maintenance, updates, or security purposes. We will provide reasonable notice when possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSETO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold CONSETO harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately, and we may delete your data after a reasonable retention period.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Services. Continued use after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Slovakia. Any disputes shall be resolved in the courts of Prešov, Slovakia, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
